Attorney General Bats For Regional Court Of Appeals To Reduce Burden Of Supreme Court

While delivering his address on the Constitution Day Celebrations at Vigyan Bhavan, the Attorney General for India KK Venugopal today spoke about the need for the creation of a Court of Appeals in at least 4 regions (North, South, West, and East) with 15 judges consisting of 3 benches of 3 judges each.

Section 362 CrPC Does Not Empower Court To Suo Motu Recall Orders Passed By It

The Supreme Court observed that Section 362 of the Code of Criminal Procedure does not empower a court to suo moto recall the earlier order passed by it.

The court said that Section 362 CrPC only provides for correction of any clerical or arithmetical error.

Murder Trial - Injured Witness's Evidence Not At A Higher Pedestal

The Supreme Court has held that the principle that the evidence of an injured witness has to be placed at a higher pedestal may not apply to a case of private defense when the accused is also injured. A Bench comprising Justices Sanjay Kishan Kaul and M.M. Sundresh allowed a batch of appeals filed by the accused assailing the charges framed in the first charge sheet, while it dismissed the set of appeals filed by the de facto complainant over a trial started pursuant to the second charge sheet filed after further investigation.

'Supreme Court Not A Walk In Place Just Because Chandigarh Is Near To Delhi'

The Supreme Court recently dismissed with Rs 20,000 costs a special leave petition which was filed challenging an adjournment order passed by Punjab and Haryana High Court. Disapproving the filing of the SLP, the Supreme Court observed that the Top Court is not a walk-in place only because Chandigarh happens to be in proximity to Delhi.
